Driving License Scooter Laws<br /><br />Depending on your state depending on your state, you may not have to obtain a license to drive a scooter. Although the rules for mopeds may differ slightly from states to states, the majority consider them to be a type of motorcycle and have similar laws in place.<br /><br />In Pennsylvania the state, it is defined by the state as a moped as a vehicle with two wheels, pedals designed for use with the feet to assist in propulsion and an engine no bigger than 50 cc. The moped must also travel at a maximum speed of 30 mph when it is on level ground. Anyone riding a moped must wear at all times a helmet and the vehicle has to be registered, insured, and examined.<br /><br />In Michigan, mopeds are motor-driven bicycles that are not intended to carry people. These two-wheeled cycles are not required to be registered or titled however, drivers must have an appropriate driver's license or moped permit to operate on public roads. All moped drivers must also be insured for liability.<br /><br />Montana, like Pennsylvania also classifies mopeds as being a type of motorbike, and requires the operator to have a Class M or MJ (motorcycle) license to operate them. In addition, the state requires that all drivers have a helmet and eye protection when riding mopeds. The registration procedure for mopeds is the same as that of regular motorcycles, and all owners must register them and show proof of insurance to use on public roads.<br /><br />Other states have similar regulations for scoots and mopeds. They require that they are titled, insured and registered. A valid driver's licence or moped license is also required to operate them on the public roads. They are typically constructed of pressed steel or alloy wheels and have interchangeable front-and-rear tires. There are a variety of options for braking systems, including both drum and mechanical disc brakes and electronic or regenerative braking.<br /><br />In New York, a moped or scooter can be operated without a license so provided that it meets certain specifications. These include pedals designed to be used by humans to propel themselves and a floorboard that is made to be sat on while operating the vehicle. They also require an engine no larger than 50 cc, and less than two horsepower for brakes. Additionally, mopeds and scooters are only allowed to be used on roads with an upper limit of 30 mph or less.<br /><br />If your scooter is equipped with an engine that is larger than 50 cc or produces more than 2 horsepower of brake power, it will likely be classified as a motorcycle and you will need to get it titled, registered and licensed. You must follow the same rules like you would if you were driving the car. When riding on public roads, you will need to wear a motorcycle helmet.<br /><br />In some states, like Connecticut, motor scooters are considered mopeds, and must be registered and tagged. They can only be used on roads with a posted speed limit of 30 or less and cannot be operated on sidewalks or in bicycle lanes. A helmet is also required for those who are younger than 18. Mopeds and scooters are also required to be parked upright so that sidewalks can be used by pedestrians.<br /><br />Motorcycles<br /><br />In a number of states, motorized scooters that have a top speed of 30 mph or more on level ground, and do not include pedals for propulsion, are categorized as motorcycles and must be titled and insured. Motorized bicycles should also be treated in the same way as motorcycles. Both kinds of vehicles require that riders wear eye protection as well as a helmet. In Georgia, for instance all drivers and riders of motorized bicycles and mopeds are required to wear helmets in order for them to be allowed on the road.<br /><br />The process for getting an motorcycle license is generally similar to the process for getting the regular driver's license and typically involves passing a written knowledge test at the local Driver License Exam Station and taking an on-cycle driving test. Once you have passed both of these tests, the next step is taking your motorcycle road test on an off-street course with a trained examiner.<br /><br />You must bring your motorbike with a helmet and appropriate eye protection for the road test. After passing your road test you will be issued a motorized bike license. In most cases, you'll also need to register your motorcycle and pay a small fee.<br /><br />Motorcycles are generally deemed to be more dangerous than mopeds, and therefore require a higher minimum age for licenses to operate and stricter regulations for operation. For instance, in New Mexico, you must be at least 16 years old older to operate a motorbike and pass a safety course, rider's examination, and an examination of riding skills.<br /><br />A helmet is also required if you are riding a motorcycle on public property, including private properties. You must also carry insurance for liability on your vehicle.<br /><br />If you intend to operate your motorized scooter on highways, you'll require a class M motorcycle license. This license is valid on all vehicles that have motors that are 50 cc or more. However, you will still need to pass the knowledge and driving test in order to obtain a motorcycle licence. You'll also have to register your motorcycle and pay the small registration and inspection fee.<br /><br />Licensing<br /><br />There is confusion about the laws in New York City regarding who is allowed to drive what type of scooter, which can result in legal issues. To be classified as one motor, it must have less than 50 ccs, and produce no more than 2 horsepower of brake power. The vehicle also has to be inspected and you must get an M Class license to operate it on the streets.<br /><br />Most people will only consider a scooter if it's street legal. In New York it is only permitted to be driven on the streets and bike lanes. It cannot be driven on a sidewalk, and it is not permitted to "lane-split," or drive between cars. It must be driven in the correct lane and adhere to all traffic laws, for example, not crossing solid white lines or passing cars on the left.<br /><br />As a New York City attorney who has represented clients across the state, I know how difficult it can be to know what scooters are permitted in what areas and under which classes of license.
